According to attorney Kent Winningham, Indianapolis Infertility and Cline likely settled for $100,000 in each of the claims, which is the maximum liability for a certified healthcare practitioner.
In each of those legal lawsuits, the Patients Compensation Fund paid an additional $350,000 in “damages” or compensation.
According to Winingham, a medical malpractice cap of $500,000 certainly applies to these lawsuits because the civil suits include events from the 1970s and 1980s. In total, the doctor paid around $1.3 million.
According to him, if Cline were sued today for the same conduct, the medical malpractice cap would be $1.8 million ($1.3 million from the Patients Compensation Fund and $500,000 from the qualified healthcare provider).
Dr. Donald’s medical license was also taken from him, but he did not face any jail time.
